Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Peptalk mobile application and related services (the "Service"). The Service is operated by Ryan Som, a sole trader based in Australia (ABN registration pending) ("Peptalk," "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please also read our Privacy Policy, which explains how we collect, use, and share your information and which forms part of these Terms.
1. Acceptance and eligibility
By accessing or using the Service you confirm that you are able to form a binding contract with us and that you accept these Terms.
The Service is intended for users aged 18 or older. If you are under 18 but at least the minimum digital-consent age in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed to children under 13 (or the equivalent minimum age in your jurisdiction), consistent with our Privacy Policy. The App Store age rating (12+) is a content rating and is separate from the contractual eligibility requirement in this section.
If you use the Service on behalf of another person or an organisation, you confirm that you are authorised to accept these Terms for them.
2. The Service
Peptalk is a habit and wellbeing coaching tool. It helps you set a small number of daily intentions and supports them through scheduled voice calls with an AI coach, habit tracking, streaks, and reminders.
The Service is currently offered as an early alpha release to a limited group of testers. Features may be incomplete, may change, and may not always work as intended. We may add, change, or remove features at any time, and we provide the Service on an "as available" basis.
3. Your account
To use the Service you create an account. You agree to:
- provide accurate information and keep it up to date;
- keep your login credentials secure and not share your account;
- be responsible for activity that happens under your account; and
- tell us promptly if you believe your account has been accessed without your permission.
You may delete your account and associated data at any time from within the app (Settings → Account → Delete Account).
4. Coach calls, phone numbers, and carrier charges
A core part of the Service is voice calls placed to you by the AI coach.
- Consent to be called. If you provide a phone number and enable coach calls, you consent to receiving automated voice calls from the Service at the times you schedule. You can change your call schedule, or turn calls off entirely, at any time in the app.
- Carrier charges. Standard call, data, and messaging charges from your mobile or telephone carrier may apply, and you are responsible for them. We are not a telephone carrier.
- Call handling. Calls are carried and processed by our telephony and voice providers as described in the Privacy Policy. Calls may be transcribed and stored so the coach can reference prior conversations.
- Reliability. Calls depend on mobile networks, third-party providers, and your device. We cannot guarantee that every call will connect, complete, or arrive on time.
- Caller ID. A coach call may arrive from a phone number you do not recognise.
5. The AI coach is not professional advice — please read
Peptalk is a habit-formation and general wellbeing coaching tool. It is not a healthcare, medical, mental-health, crisis, legal, financial, or other professional service, and it does not provide professional advice. The AI coach generates conversational responses automatically; its output may be inaccurate, incomplete, or unsuitable for your circumstances. Do not rely on it as a substitute for advice from a qualified professional.
The Service is not for emergencies. It is not monitored by a human in real time and cannot perceive or respond to a crisis. If you are experiencing a medical or mental-health emergency, or you are thinking about harming yourself or someone else, stop using the Service and seek help immediately:
- In Australia: call 000 for emergencies, or Lifeline on 13 11 14.
- Outside Australia: contact your local emergency number or crisis service. [TBD — add region-specific crisis resources before the Service is offered outside Australia.]
Always consult a qualified professional before making decisions about your health, finances, or other important matters. Your use of the AI coach is at your own discretion and risk.
6. Acceptable use
When using the Service, you agree not to:
- use the Service for any unlawful purpose or in breach of these Terms;
- attempt to disrupt, overload, reverse engineer, or gain unauthorised access to the Service or its systems;
- use the Service to harass, abuse, or harm another person;
- misrepresent your identity or impersonate anyone;
- scrape, copy, resell, or commercially exploit the Service or its content except as expressly permitted; or
- use the Service in any way that could damage, disable, or impair it, or interfere with anyone else's use of it.
We may suspend or limit access if we reasonably believe you are breaching this section.
7. Subscriptions and billing
[TBD — Peptalk is free of charge during the alpha period; no paid features are offered at this time. If and when paid plans are introduced, this section will set out pricing, billing cycles, automatic renewal, cancellation, refunds, and how purchases made through the Apple App Store are handled under Apple's terms.]
8. Your content and our intellectual property
- Your content. You keep ownership of the information you put into the Service — your goals, habits, check-ins, notes, and what you say on calls ("Your Content"). You grant us a limited, non-exclusive licence to host, process, and use Your Content solely to operate, maintain, and improve the Service for you, as described in the Privacy Policy.
- Our content. The Service — including its software, design, and the "Peptalk" name and branding — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by law.
- Feedback. If you send us suggestions or feedback about the Service, we may use them without any obligation or compensation to you.
9. Disclaimers, liability, and indemnity
- "As is." To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.
- Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for a failure to comply with such a guarantee can be limited but not excluded, our liability is limited to the maximum extent permitted by law.
- Limitation of liability. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss, or for any loss of data, profits, or goodwill, arising from or relating to your use of (or inability to use) the Service. Subject to the Australian Consumer Law paragraph above, our total liability arising out of or relating to the Service is limited to the greater of the total amount you paid us for the Service in the 12 months before the claim, or AUD 100.
- Indemnity. You agree to indemnify us against reasonable claims, losses, and costs arising from your breach of these Terms or your misuse of the Service, except to the extent the claim, loss, or cost was caused by us.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we reasonably need to for security or legal reasons, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive termination — including content licences, disclaimers, limitation of liability, indemnity, and governing law — continue to apply.
11. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that place. This clause does not deprive you of the protection of the mandatory consumer laws of the place where you live.
12. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will notify you in the app or by email before they take effect. The "Last updated" date above reflects the most recent version. If you continue to use the Service after changes take effect, you accept the updated Terms.
